I. General ToS

I reserve the right to reject any order.Clients are required to write a clear description & reference images in their request forms. Avoid making a wall of text.I do not accept NSFW requests or tolerate inappropriate behavior from clients. (e.g., harassment, discrimination, threats, coercion, or any form of communication or conduct that is offensive, disrespectful, or harmful towards the artist or any third party.)Failure to comply with these terms may result in termination without a refund. Abuse of chargebacks will be addressed accordingly.

II. Payment

All payments will be processed upfront through the Artistree.io payment system.Prices will vary depending on the complexity of the request.Once the form has been received and reviewed, the artist will carefully evaluate the details to determine the final price.Extra fees will apply per additional character or background.Currency Conversion Fees: All prices are enlisted in USD. Clients using currencies other than USD are responsible for any currency conversion fees imposed by their payment provider. These fees are non-reimbursable by the artist.Rushing Fee: Request for expedited delivery may incur an additional fee. The amount will depend on the urgency & complexity of the project and will be communicated to the client before work begins.

III. Process & Delivery

Project completion time will vary based on factors like the health or complexity of the project. (e.g., personal emergencies, technical issues.)Delivery includes a full-resolution image. Only non-tangible goods are provided, and all rights remain with the creator. Unless otherwise stated.Work-in-progress images will be provided as low-resolution files with watermarks to safeguard against unauthorized use or theft

IV. Revisions

Clear references and timely feedback from clients are essential for ensuring timely completion and customer satisfaction. Inadequate references or delayed feedback may lead to delays and hinder the artist's ability to fully satisfy the customer's needs.Some minor edits may be permitted, but major or excessive changes will incur additional fees.Be decisive & avoid sudden changes. If you tell me to draw a person and then, in a revision, change it to a monkey, I will cancel your commission. No refunds.Respect the revision process and avoid frequent changes to keep the project on track.

V. Artist & Customer

Artist (Me):

Retains copyright but doesn't claim the client's characters.Reserves the right to share commissioned art in my portfolio, on social media, or for promotional purposes.May cancel or refund commissions at discretion.Can decline uncomfortable requests.

Customer (You):

Can't profit commercially or claim work without purchasing rights.Can't alter work without explicit permission.Special permissions for adoptable art or media use are negotiable.

VI. Copyright Infringement & Usage

As the artist, I own all rights to the drawing, not the commissioner. I can use it for promotion, publication, display, and posting as I see fit. I will take legal action against any copyright infringement.The copyrighted artwork is for personal use ONLY unless stated otherwise. The client may print the artwork for personal use, but may not claim the artwork or its design as their own. Self-promotion with proper credit to the artist is permitted. Any copyright infringement will result in revoking previously granted rights.Commercial reproduction or use of the copyrighted artwork, which involves profiting from it in any manner, is strictly prohibited. Claiming credit for the creation of the artwork is forbidden. Removing any watermarks or signatures is not permitted. Additionally, altering the artwork without the explicit consent of the artist is prohibited.Limited commercial use for promotion is allowed with proper attribution. Further commercial use requires explicit permission and may incur fees.You are prohibited from using or modifying the commissioned work in the following ways:

VII. Refunds & Cancellations

Refunds and cancellations may ONLY be considered before work begins due to unforeseen circumstances. (e.g. technical issues, sudden health complications, the customer being unable to pay.)Usage of work in progress or final artwork for personal or commercial purposes is prohibited if the commission is canceled.There are no refunds or cancellations after work commences. Chargebacks are not allowed.If you initiate a chargeback against me, you forfeit all rights to any work I've created for you, and I reserve the right to sell the copyrighted artwork to new clients. Additionally, you'll be prohibited from commissioning me in the future. Your name may be publicly disclosed as a cautionary measure for others. Furthermore, I retain the right to file a complaint and reclaim any funds you've provided.

VIII. Privacy / Confidentiality

All information shared during commissions is kept confidential.Sensitive information won't be disclosed without client consent.

IX. Termination of Agreement

The artist may terminate the contract due to breach of terms or failure to fulfill obligations.Termination may result in forfeiture of work completed, with or without refunds, according to the cancellation policy.
